  • Scope of potentially accessible evidence and jurisdiction-specific reservations;
  • Practical experience in various Asia-Pacific jurisdictions; and
  • Other jurisdiction-specific measures to block or facilitate collection of evidence.

Second Roundtable: Overseas Service of Process and the Hague Convention

  • Regional differences in implementation;
  • Standards applied in the local courts when determining whether the service of foreign process is proper and effective;
  • Standards that apply to particular types of documents;
  • Standards that apply when foreign language documents are served without a translation; and
  • Practical experiences using the Hague Convention in various jurisdictions.

Third Roundtable: Witnesses in International Arbitration Proceedings

  • Discussion of witness testimony generally in courts of the respective jurisdictions;
  • Approaches to witness preparation, and how this differs in domestic proceedings compared to international arbitration,
  • In light of the degree of similarities or differences, how much weight should be given to witness testimony;
  • Practical experiences with witness testimony through an interpreter; and
  • Cultural factors that arbitrators should be aware of when evaluating the credibility of witnesses.
