Join presenter Todd Aagaard, Professor of Law, during Earth Week to explore the latest in environmental law and policy.
In the absence of major climate legislation, federal regulation has addressed climate change on a limited basis using existing statutory authorities. During the Obama Administration, the Environmental Protection Agency developed the Clean Power Plan, which regulated carbon emissions from existing power plants under the Clean Air Act. President Trump campaigned against the Clean Power Plan, and under his Administration, the EPA repealed the Clean Power Plan and replaced it with the more lenient Affordable Clean Energy Rule. In January, the D.C. Circuit Court of Appeals held that the Affordable Clean Energy Rule was invalid. This decision sets an important precedent that will help shape how the Biden Administration will regulate carbon emissions.
