THE AIR CANADA & UNITED AIRLINES RACE 2024 CONTEST FOR TRAVEL AGENTS (the “Contest”)

OFFICIAL CONTEST RULES AND REGULATIONS (the “Contest Rules”)

 NO PURCHASE OR MONETARY CONSIDERATION NECESSARY TO ENTER OR WIN.

The Contest is brought to you by United Airlines ®, Air Canada and Tourism Ireland (the “Contest Organizers”) The contest starts on April 1, 2024, at 12:01 a.m. EST and closes on June 30, 2024 at 11:59 p.m. EST (hereinafter, the “Promotion Period”).

The rules below apply to select U.S. agencies and their employees. The Race part of the promotion will take place in Dublin, Ireland on September 23, 2024 (the “Race”).

1. Eligibility: This contest is open to employees and affiliated travel agents of select accredited travel agencies (the “Eligible Agencies”) who are at least 18 years old. (Eligible Agencies and Eligible Travel Agents, hereinafter collectively referred to as the “Eligible Participants”). Directors, employees, representatives, or agents (excluding Eligible Participants, as defined above) of Contest and its subsidiaries and affiliates, media partners, advertising and promotional agencies, and members of the immediate family (parents, children, siblings and spouse, regardless of where they are domiciled) of any of the aforementioned and persons with whom any of the aforementioned are domiciled are not eligible to enter the Contest.

2. How to participate in the Contest: No Purchase Necessary. Eligible Participants can enter the Contest either via (I) Training Program Entry or (II) Tickets/Bookings Entry.

I. Training Program Entry: Eligible Travel Agents who complete the modules in the online training program using the links provided by the Contest Promotion Organizer, are eligible to win prizes. The training program will include weekly modules and quizzes that contain information about United Airlines, Air Canada and Tourism Ireland. The first communication, sent to Agency owners, will include a link to the terms and conditions of The Race, as well as a landing page where their agents are able to register for this promotion. The Agency owner will share the link with their agents.

II. Tickets/Bookings Entry: Eligible Travel Agents who are registered and booked a transatlantic ticket, plated on UA016, AC014, LH220, LX724, OS257 or SN082, between April 1, 2024, and June 30, 2024, for flights operated by United Airlines, Air Canada, and Lufthansa group airlines are eligible to enter the Contest. Travel period: April 1 – December 31, 2024. Eligible tickets (“Eligible Tickets”) must be booked through the agency’s ARC. Award tickets and the purchase with flight credits are excluded from qualifying as Eligible Tickets for participation in the Contest. Each Eligible ticket booked earns one chance for the Agency to participate in The Race. Fifteen (15) spots in the Race will be randomly selected and allocated to Eligible Agencies whose Eligible Travel Agents have received an entry through the above methods listed in i) and ii).

3. Prizes: There are a total of 8 secondary prizes and 15 grand prizes, (each referred to individually as “Prize” and collectively as the “Prizes”) to be won during the Contest Period, consisting of: Secondary Prizes: There is a total of eight (8) secondary prizes available to be won by Eligible Travel Agents who participate in the Learning Modules. Eligible Entries received by Eligible Travel Agents will be held on July 2, 2024.

1. One (1) entry will be drawn for one (1) luxury crystal item valued at $100 USD each.
2. Two (2) entries will be drawn for one (1) $100 CAD Air Canada gift card and one (1) branded carry-on luggage valued at $75 USD.
3. One (1) entry will be drawn for one (1) pair of International Maple Leaf Lounge passes valued at $75 USD.
4. One (1) entry will be drawn for one (1) pair of United Airlines lounge passes valued at $118 USD .
5. Two (2) entries will be drawn for one (1) for 10,000 UA Bonus miles valued at $75 USD and one (1) $100 CAD Air Canada gift card.
6. One (1) entry will be drawn for one (1) United bag valued at $75 USD.

Grand Prizes. There are a total of fifteen (15) grand prizes (the “Grand Prizes”) available to be won by Eligible Agencies who received an Eligible Entry during the Contest Period. Eight (8) race spots will be drawn from completion of the learning modules, and seven (7) race spots from the booking contest. The Eligible Entry drawn will consist of: 

One (1) Economy Class round-trip ticket onboard a flight operated by United Airlines (including flights operated under the United Express banner) from the major U.S. airport served by United Airlines closest to the winner’s place of residence in the U.S. to Dublin Ireland, valued at approximately U.S. $ 2,775 each. All travel is subject to United Airlines’ contract of carriage.

 The agencies who earned a spot to participate in The Race, will select which of their employees will participate.

Prize must be accepted as awarded and may not be sold, transferred or converted to cash and will not be refunded if unused. No substitutions, changes or extensions are permitted. Contest Organizer reserves the right at its sole discretion to substitute the Prize for one of equal or greater value or to allow a Prize transfer.

4. Prize Draw: A random draw from all Eligible Entries received by Eligible Agencies during the Contest Period for a chance to take part in the Race will be on the July 2, 2024. Fifteen (15) Eligible Agencies drawn for a spot in the Race will be announced on July 15, 2024. The odds of winning a Prize will depend upon the total number of Eligible Entries received from Eligible Participants during the Contest Period. Limit of one (1) Prize per person.

Taking part in the Race

The Eligible Agencies selected by random draw, will be contacted by telephone or by e-mail by the Contest Organizer or one of its representatives. Once the Eligible Agency has been contacted, to be officially declared a participant in the Race, the Eligible Agency must confirm acceptance and provide their designated Race participant’s name within five (5) business days of initial notification (the “Race Participant”). If the selected Eligible Agency cannot be contacted for five (5) business days, another Eligible Agency will be selected as per the methods described above. Once an Eligible Agency is confirmed as a Race Participant, the Contest Organizer will send by email the Eligible Agency and the Race Participant a letter containing the details of the Race.

If selected, the Prize winner must be available to travel on the specified dates. 

Travel does not qualify for MileagePlus miles or any other frequent flyer program. No changes permitted to reservations once date of travel is confirmed, or ticket has been issued. 

The departure date for travel to Dublin is scheduled for September 21, 2024, and the return date, from Dublin, is scheduled for September 28, 2024. The Contest Organizer reserves the right to modify the dates of the Race, including the travel dates.

The Race Participants are responsible for: any and all costs, expenses and taxes not expressly described herein including, without limitation, ground transportation, gratuities, merchandise, telephone calls, personal expenses of any nature for overnight layovers, meals and beverages, service charges, in-flight meals and entertainment; costs incurred to and from the departure point (as the Prize originates and terminates at such departure point), obtaining sufficient personal travel insurance prior to departure, if desired; obtaining and carrying all necessary travel documentation, such as passports and visas, proof of vaccination against COVID-19 and complying with entry, health, safety, customs and immigrations regulations and requirements.

The Race Participants agree and acknowledge that Contest Organizer will not be liable if they are denied boarding due to any failure to comply with applicable travel restrictions or requirements. The Race Participants understand and acknowledge the risks related to the spread of infectious or contagious diseases and understands it remains their responsibility to take the necessary precautions applicable to any health hazards.

The Contest Organizer hereby reserves the right to cancel the Race at its sole discretion.

5. Claiming of Prize(s): In order to be declared a winner and be able to claim their Prize, the Eligible Participant selected as per these Contest Rules will be contacted by telephone, e-mail, direct message or other form of notification sent to the information provided accompanying the selected Eligible Entry. If the selected Eligible Participant does not confirm acceptance within three (10) calendar days, the Eligible Participant will be automatically disqualified and forfeit all rights to the Prize. At its entire discretion, Contest Organizer may select another Eligible Participant among the Eligible Entries by way of random draw.

Before being declared a Prize winner, each selected Eligible Participant will be required to successfully answer a time-limited four-step, two-to-three number mathematical skill-testing question and sign a declaration form confirming, without limitation, that:

o   they comply with the eligibility requirements;

o   they have read the Contest Rules and comply completely;

o   they accept the Prize as awarded;

o   they comply with any conditions/restrictions that may apply to the Prize;

o   they acknowledge the Contest Organizer’s right to publish their picture, name and city of residence without compensation other than the Prize offered; and

o   they acknowledge the disclaimer of liability from the Contest Organizer, Contest Sponsor (if applicable) and their respective parent, subsidiaries and affiliates, media partners, advertising, promotional agencies and each of the foregoing entities’ directors, officers, employees, contractors and agents.

No correspondence will be undertaken except with the selected Eligible Participants whose Eligible Entry was drawn. Once an Eligible Participant is declared a Prize winner by the Contest Organizer, the Contest Organizer will send the Eligible Participant an email containing the details of how to redeem their Prize.

 6. General Terms and Conditions: All Submissions and all information provided by Eligible Participants must be complete and accurate. Contest Organizer will not be held responsible for any incorrect or inaccurate transcription of entry information, any error or technological malfunctions of any kind in connection with the Contest, telephone or internet interruptions and/or any late/incomplete/erroneously completed Prize claims or declaration forms or validly disqualifying any Eligible Participants or winner(s) in accordance with the terms hereof.

All Submissions are subject to verification by the Contest Organizer and may be disqualified if they are received outside of the Contest Period, are incomplete, illegible, irregular, photocopied or otherwise reproduced, submitted through illicit means or if they contain any false statements, or do not conform to or satisfy any condition of these Contest Rules.

The contents of all entries submitted become property of the Contest Organizer and will not be returned. Each Eligible Participant grants permission for Contest Organizer and Contest Sponsor (if applicable) to use the contents of their Eligible Entry including name and address for editorial, advertising, marketing and promotional purposes in any and all media now known or hereafter discovered, worldwide, in perpetuity, without compensation, notification or permission. Contest Organizer reserves the right to: (i) use the contents of Eligible Entries provided by entrants, for editorial, advertising, marketing and promotional purposes, without further compensation or notice, unless prohibited by law; and (ii) publish without compensation the full name, city of residence, and photograph of all Prize winners and Eligible Participants waive all rights with respect to printed, broadcast and other forms of publicity.

By entering the Contest, Eligible Participants expressly consent to the Contest Organizer, Contest Sponsor (if applicable), media partners, advertising and promotional agencies, storing, sharing and using the personal information submitted with their Eligible Entry only for the purpose of administering the Contest. Contest Organizer will retain the personal information according to applicable laws.

If the Contest is not capable of running as planned for any reason, including tampering, unauthorized intervention, fraud, technical failures, or any other cause, the Contest Organizer reserves the right, at its sole discretion, to, without advance notice, terminate or suspend the Contest, in whole or in part, or modify it in any way, without any further obligations to Eligible Participants. Furthermore, if the Contest Organizer determines, at its sole discretion, that any entry compromises the integrity of the Contest, the Contest Organizer reserves the right to disqualify the entry at issue or terminate the Contest in its entirety without any further obligations to Eligible Participants. The Contest Organizer further reserves the right, at its sole discretion, to disqualify any individual from the Contest, and/or to revoke, rescind, withhold or otherwise limit or restrict the Prize awarded to a winner, and/or to ban the individual from any future contest of the Contest Organizer who it finds or believes to be: (i) tampering with the entry process or the operation of the Contest; (ii) acting in violation of the Contest Rules or in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person; (iii) acting or involved in any situation or occurrence which brings them into public disrepute, contempt, scandal, or ridicule, or which shocks, insults, or offends the community or any group or class thereof, or to offend public morals and decency to or which reflects unfavorably upon the Contest Organizer, the Contest Sponsor (if applicable), the Prize supplier, if any, and each of their respective parent, subsidiaries and affiliates, media partners, advertising and promotional agencies and each of the foregoing entities’ respective directors, officers, employees, agents, representatives, successors and assigns, or their respective products or services, as determined in the reasonable discretion of the Contest Organizer; or (iv) posting or making available to the public any post, picture, video, statement, or any other content of any form on any media (including any social media platform) mentioning, tagging, alluding to, or associating itself in any way with the Contest and/or the Prize which, in the reasonable discretion of the Contest Organizer, infringes or otherwise violates the rights of the Contest Organizer, the Contest Sponsor (if applicable), the Prize supplier, if any, and each of their respective parent, subsidiaries and affiliates, media partners, advertising and promotional agencies and each of the foregoing entities’ respective directors, officers, employees, agents, representatives, successors and assigns.

By entering this Contest, Eligible Participants agree that the Contest Organizer and Contest Sponsor (if applicable) and each of their respective subsidiaries and affiliates, media partners, advertising and promotional agencies and each of the foregoing entities’ respective directors, officers, employees, agents, representatives, successors and assigns do not make any representation or warranty, or assume any liability beyond, where applicable, what has been described as the Prize in these Rules.

Eligible Participants agree to be bound by all decisions of the Contest Organizer and/or Contest Sponsor (if applicable) regarding the Contest, which shall be final and binding in all respects.

The Air Canada & United Airlines Race will take place in Dublin, Ireland on September 23^rd, 2024 (the “Race”).

Eligibility: The Contest is open to selected IATA accredited travel agencies (the “Eligible Agencies”) as well as all Canadian residents having reached the legal age of majority in their province or territory of residence prior to the Contest Period who: (i) are regular, full-time employees of IATA & TIDS approved travel agencies in good standing with Contest Organizer as determined by Contest Organizer in its sole discretion; and (ii) hold a valid IATA Canadian Travel Industry I.D. card (each an “Eligible Travel Agents”). (Eligible Agencies and Eligible Travel Agents, hereinafter collectively referred to as the “Eligible Participants”) Directors, employees, representatives, or agents (excluding Eligible Participants, as defined above) of Contest Organizer, Contest Sponsor, Tourism Ireland and each of their respective subsidiaries and affiliates, media partners, advertising and promotional agencies, and members of the immediate family (parents, children, siblings and spouse, regardless of where they are domiciled) of any of the aforementioned and persons with whom any of the aforementioned are domiciled are not eligible to enter the Contest.

How to participate in the Contest: No Purchase Necessary. Eligible Participants can enter the Contest either via (I) Training Program Entry or (II) Tickets/Bookings Entry, detailed as follows:

1. Training Program Entry: Eligible Travel Agents who complete all the modules in the online training program using the links provided by the Contest Organizer, which will include Tourism Ireland training modules and other Air Canada and United Airlines weekly quizzes (the “Training Program”) during the Contest Period are eligible to enter the Contest. On March25th, 2024, the first communication to be sent to Eligible Agencies will include the terms and conditions to enter in the Contest. The Eligible Agents within the Eligible Agency will be responsible to register by clicking on a link which will lead them to a landing page where they will be able to register.

2. Tickets/Bookings Entry: Eligible Travel Agents who book a Transatlantic ticket through Air Canada, United Airlines or a Transatlantic Joint Venture carrier (plated on AC014, LH220, LX724, OS257, SN082 or UA016) between  April 1^st through June 30^th, 2024 for travel between  April 1^st to December 31^st, 2024 for flights operated by Air Canada, Air Canada Rouge or under the Air Canada Express brand or flights operated by the Transatlantic Joint Venture Carriers, booked through their Global Distribution System, aircanada.com/agents, via the Air Canada for Business platform, Air Canada Web link or through an ac2u connected provider (the “Eligible Tickets”) during the Contest Period are eligible to enter the Contest. The purchase of Flight Pass credits is excluded from qualifying as Eligible Tickets for participation in the Contest. The fifteen (15) spots in the Race will be selected by random draw from the Eligible Agencies whose Eligible Travel Agents have submitted an entry through the above methods listed in i) and ii). Although online access is required in order to enter the Contest via certain methods of entry detailed above, no purchase is necessary.

Entry Requirements:To be considered an Eligible Entry, as defined below, all content and materials associated with your entry (regardless of the method of entry) (collectively, the “Submission”) must: (i) be submitted and received in accordance with these Contest Rules during the applicable Contest Period; (ii) include all required components and materials noted above; and (iii) comply with these Contest Rules, including, but not limited to, the General Term and Conditions listed below for each Prize (all as determined by the Contest Organizer in its sole and absolute discretion). By participating in this Contest, including without limitation submitting an Eligible Entry, you signify that you have read and agree to be legally bound by these Contest Rules. Each Submission received from an Eligible Participant that meets the requirements above will be considered an “Eligible Entry” and collectively the “Eligible Entries”.

Prizes & Prize Draws: There are a total of twenty-three (23) prizes (each referred to individually as a “Prize” and collectively as the “Prizes) to be won during the Contest Period, consisting of: Secondary Prizes. There are a total of eight (8) secondary prizes (the “Secondary Prizes”) available to be won by Eligible Travel Agents.  A random draw from all Eligible Entries submitted by Eligible Travel Agents will be held virtually at Contest Organizer’s offices located at: 20 Queen Street West, 26^th floor, Toronto, ON, M5H 3R3 on July 2^nd 2024 for all Secondary Prizes listed below :

1. One (1) entry will be drawn for one (1) Tourism Ireland crystal valued at USD $100 (approximately CAD $135).
2. Two (2) entries will be drawn for one (1) $100 Air Canada gift card and one (1) branded carry-on luggage valued at CAD $100.
3. One (1) entry will be drawn for one (1) pair of International Maple Leaf Lounge passes valued at CAD $100.
4. One (1) entry will be drawn for one (1) pair of United Airlines lounge passes valued at USD $75 (approximately CAD $101.60).
5. Two (2) entries will be drawn for one (1) for 10,000 UA Bonus miles valued at CAD $100 and one (1) $100 Air Canada gift card.
6. One (1) entry will be drawn for one (1) carry-on luggage valued at $75 USD (approximately CAD $101.60).

The total value of the Secondary Prizes is approximately CAD $838.20 according to exchange rates of March 18^th, 2024.

Grand Prizes. There are a total of fifteen (15) grand prizes (the “Grand Prizes”) available to be won by Eligible Agencies who submitted an Eligible Entry during the Contest Period, consisting of: 

• One (1) Economy Class round-trip ticket onboard any flight operated by Air Canada (including, flights operated under the Air Canada Express banner and operated by Air Canada Rouge) from the major Canadian airport served by Air Canada closest to the Race Participant’s place of residence to Dublin, Ireland in order to participate in the Air Canada Race, valued at CAD $1750 each.

The total value of the Grand Prizes is CAD $26,250.

A random draw from all Eligible Entries submitted by Eligible Agencies during the Contest Period for a chance to take part in the Race and receive a Grand Prize will be held virtually at the Contest Organizer’s offices located at: 20 Queen Street West, 26^th floor, Toronto, ON, M5H 3R3 on July 2^nd, 2024. The fifteen (15) Eligible Agencies selected by random draw for a spot in the Race will be announced on  July 2^nd, 2024. The odds of winning a Prize will depend upon the total number of Eligible Entries received from Eligible Participants during the Contest Period.  Limit of one (1) Prize per person.

Total Prize Value:The approximate value of all Prizes is: CAD $27,088.20. Exact value of the Prize depends on point of departure and destination as well as time of travel. Prize must be accepted as awarded and may not be sold, transferred or converted to cash and will not be refunded if unused. No substitutions, changes or extensions are permitted. Contest Organizer reserves the right at its sole discretion to substitute the Prize for one of equal or greater value or to allow a Prize transfer.

Note: This Contest will be administered with the federal and provincial tax guidelines. The Prize constitutes taxable income, except in limited circumstances. The Prize winner is solely responsible for the reporting and payment of any applicable taxes with respect to any Prize received under the Contest.  Air Canada will report the Prize amount on a T4A or such other prescribed tax forms.

Use of Air Canada gift cards is subject to Air Canada Gift Card’s Terms and Conditions publicly available at https://www.aircanada.com/ca/en/aco/home/book/payment-methods/air-canada-gift-cards.html.

International Maple Leaf Lounge Passes

Use of International Maple Leaf Lounge passes is subject to Maple Leaf Lounge’s Terms and Conditions publicly available at https://www.aircanada.com/ca/en/aco/home/fly/premium-services/maple-leaf-lounges.html#/.

Taking Part in the Race:The Eligible Agencies selected by random draw, will be contacted by telephone or by e-mail by the Contest Organizer, Contest Sponsor or one of its representatives. Once the Eligible Agency has been contacted, in order to be officially declared a participant in the Race, the Eligible Agency must confirm acceptance and provide their designated Race participant’s name within five (5) business days of initial notification (the “Race Participant”). If the selected Eligible Agency cannot be contacted for five (5) business days, another Eligible Agency will be selected as per the methods described above. No correspondence will be undertaken except with the selected Eligible Agency whose Eligible Entry was drawn. Once an Eligible Agency is confirmed as a Race Participant, the Contest Organizer will send by email the Eligible Agency and the Race Participant a letter containing the details of the Race. If selected, the Race Participant must be available to travel on the specified dates.Travel does not qualify for Aeroplan points accumulation or for mileage/points accumulation in any other frequent flyer program. No changes permitted to reservations once date of travel is confirmed or ticket has been issued. 

The departure date, from the major Canadian airport served by Air Canada closest to the Race Participant’s place of residence, to Dublin, Ireland is scheduled for September 21^st, 2024 and the return date, from Dublin, Ireland, to the major Canadian airport served by Air Canada closest to the Race Participant’s place of residence, is scheduled for September 28^th, 2024. Contest Organizer reserves the right to modify the dates of the Race, including the travel dates. For all the Race Participants, the Economy Class round-trip ticket on a flight operated by Air Canada (including, flights operated under the Air Canada Express banner and operated by Air Canada rouge) are provided by the Contest Organizer.

The Race Participants are responsible for: any and all costs, expenses and taxes not expressly described herein including, without limitation, ground transportation, gratuities, merchandise, telephone calls, personal expenses of any nature for overnight layovers, meals and beverages, service charges, in-flight meals and entertainment; costs incurred to and from the departure point (as the Prize originates and terminates at such departure point), obtaining sufficient personal travel insurance prior to departure, if desired; obtaining and carrying all necessary travel documentation, such as passports and visas and complying with entry, health, safety, customs and immigrations regulations and requirements. The use of upgrade certificates is not permitted for flights. Use of the airfare tickets are subject to Air Canada’s general conditions of carriage publicly available at www.aircanada.com. The Race Participants agree and acknowledges that Contest Organizer will not be liable if they are denied boarding due to any failure to comply with applicable travel restrictions or requirements. The Race Participants understand and acknowledge the risks related to the spread of infectious or contagious diseases and understands it remains their responsibility to take the necessary precautions applicable to any health hazards, including but not limited to COVID-19. Other mandatory safety protocols may apply based on the nature of the Prize. Availability of the services and facilities may be impacted. Contest Organizer hereby reserves the right to cancel the Race at its sole discretion.

Claiming of Prize(s): In order to be declared a winner and be able to claim their Prize, the Eligible Participant selected as per these Contest Rules will be contacted by telephone, e-mail, direct message or other form of notification sent to the coordinates accompanying the selected Eligible Entry and will be instructed on how to claim their Prize by the Contest Organizer or Contest Sponsor (if applicable) or one of its agents or representatives, shortly following the draw and must confirm acceptance as a selected Eligible Participant within five (5) calendar days of contact. Each potential Prize winner is solely responsible for ensuring their social media account settings are set such that they are able to receive such notification messages from the Contest Organizer (if applicable).

If the selected Eligible Participant does not confirm acceptance within five (5) calendar days, the Eligible Participant will be automatically disqualified and forfeit all rights to the Prize. At its entire discretion, Contest Organizer may select another Eligible Participant among the Eligible Entries by way of random draw.

No correspondence will be undertaken except with the selected Eligible Participants whose Eligible Entry was drawn. Once an Eligible Participant is declared a Prize winner by Contest Organizer, Contest Organizer will send the Eligible Participant an email containing the details of how to redeem their Prize.

General Terms and Conditions: All Submissions and all information provided, by Eligible Participants must be complete and accurate. Contest Organizer will not be held responsible for any incorrect or inaccurate transcription of entry information, any error or technological malfunctions of any kind in connection with the Contest, telephone or internet interruptions and/or any late/incomplete/erroneously completed Prize claims or declaration forms or validly disqualifying any Eligible Participants or winner(s) in accordance with the terms hereof.

The contents of all entries submitted become property of the Contest Organizer and will not be returned. Each Eligible Participant grants permission for Contest Organizer and Contest Sponsor (if applicable) to use the contents of their Eligible Entry including name and address for editorial, advertising, marketing and promotional purposes in any and all media now known or hereafter discovered, worldwide, in perpetuity, without compensation, notification or permission. Contest Organizer reserves the right to: (i) use the contents of Eligible Entries provided by entrants, for editorial, advertising, marketing and promotional purposes, without further compensation or notice, unless prohibited by law; and (ii) publish without compensation the full name, city of residence, and photograph of all Prize winners and Eligible Participants waive all rights with respect to printed, broadcast and other forms of publicity.

By entering the Contest, Eligible Participants expressly consent to the Contest Organizer, Contest Sponsor (if applicable), media partners, advertising and promotional agencies, storing, sharing and using the personal information submitted with their Eligible Entry only for the purpose of administering the Contest and in accordance with the Contest Organizer’s Privacy Policy publicly available on Contest Organizer’s website:

If the Contest is not capable of running as planned for any reason, including tampering, unauthorized intervention, fraud, technical failures, or any other cause, the Contest Organizer reserves the right, at its sole discretion, to, without advance notice, terminate or suspend the Contest, in whole or in part, or modify it in any way, without any further obligations to Eligible Participants. Furthermore, if the Contest Organizer determines, at its sole discretion, that any entry compromises the integrity of the Contest, the Contest Organizer reserves the right to disqualify the entry at issue or terminate the Contest in its entirety without any further obligations to Eligible Participants. By entering this Contest, Eligible Participants agree that the Contest Organizer and Contest Sponsor (if applicable) and each of their respective subsidiaries and affiliates, media partners, advertising and promotional agencies and each of the foregoing entities’ respective directors, officers, employees, agents, representatives, successors and assigns do not make any representation or warranty, or assume any liability beyond, where applicable, what has been described as the Prize in these Rules.

Eligible Participants agree to be bound by all decisions of the Contest Organizer and/or Contest Sponsor (if applicable) regarding the Contest which shall be final and binding in all respects.

The Contest is subject to federal, provincial and local rules and regulations. Le Concours vous est présenté par Air Canada^MD (l’« Organisateur du Concours ») et par United Airlines (le « Commanditaire du Concours »). Le Concours débute le 1^er avril 2024 à 0 h 01 (HE) et se termine le 30 juin 2024 à 23 h 59 (HE) (ci-après la « Période du Concours »).

La Course Air Canada-United Airlines se déroulera à Dublin, en Irlande, le 23 septembre 2024 (la « Course »).

1. Admissibilité

Le Concours s’adresse aux agences agréées par l’Association du transport aérien international (IATA) (les Agences admissibles) ainsi qu’aux résidents canadiens ayant atteint l’âge légal de majorité dans leur province ou territoire de résidence avant la Période du Concours et qui : (i) sont des employés permanents à temps plein d’agences de voyages approuvées par l’IATA et le Service d’identification de l’industrie touristique (TIDS) en règle avec l’Organisateur du Concours, à son entière discrétion (l’« Agence admissible »); et (ii) détiennent une carte d’identité IATA valide de l’industrie du voyage (les « Agents de voyages admissibles »).

Les Agences admissibles et les Agents de voyages admissibles sont ci-après collectivement appelés les « Participants admissibles ».

Les administrateurs, employés, représentants ou mandataires (à l’exception des Participants admissibles, comme définis ci-dessus) de l’Organisateur du Concours, du Commanditaire du Concours, de Tourism Ireland et de leurs filiales et sociétés affiliées, partenaires médias et agences de publicité et de promotion, ainsi que les membres de la famille immédiate (parents, enfants, frères et sœurs et conjoint, quel que soit leur lieu de résidence) de ces administrateurs, employés, représentants et mandataires et des personnes avec lesquelles ceux-ci sont domiciliés, ne sont pas admissibles au Concours.

2.Comment participer au Concours

Aucun achat n’est requis.

Les Participants admissibles peuvent participer au Concours par (i) une participation au moyen du Programme de formation ou (ii) une participation au moyen d’une réservation et de la délivrance d’un billet, comme il est indiqué ci-dessous :

1. Participation au moyen du Programme de formation

Les Agents de voyages admissibles qui suivent tous les modules du programme de formation en ligne à l’aide des liens fournis par l’Organisateur du Concours, lesquels comprennent des modules de formation de Tourism Ireland et des questionnaires hebdomadaires d’Air Canada et de United Airlines (le « Programme de formation ») pendant la Période du Concours sont admissibles à participer au Concours. Le 25 mars 2024, la première communication envoyée aux Agences admissibles comprendra les conditions générales du Concours. 2. Participation au moyen d’une réservation et de la délivrance d’un billet

Les Agents de voyages admissibles qui réservent des billets pour un vol transatlantique auprès d’Air Canada, de United Airlines ou d’un transporteur de la coentreprise transatlantique (plaques d’identification : AC014, LH220, LX724, OS257, SN082 ou UA016) entre le 1^er avril et le 30 juin 2024, pour un voyage effectué entre le 1^er avril et le 31 décembre 2024 à bord d’un vol exploité par Air Canada, par Air Canada Rouge ou sous la marque Air Canada Express, ou à bord d’un vol exploité par les transporteurs de la coentreprise transatlantique, billets réservés dans leur système mondial de distribution, à aircanada.com/agents, par la plateforme Air Canada pour entreprise, par un lien Web Air Canada ou ou auprès d’un fournisseur ac@vous (les « Billets admissibles ») pendant la Période du Concours sont admissibles au Concours. L’achat de crédits de Passe de vols n’est pas admissible à titre de Billets admissibles pour participer au Concours.

Les quinze (15) places pour la Course sont attribuées par tirage au sort parmi les Agences admissibles dont les Agents de voyages admissibles ont soumis une participation selon les méthodes (i) ou (ii). Bien qu’un accès en ligne soit requis pour participer au Concours par certaines des méthodes de participation ci-dessus, aucun achat n’est requis.

Exigences relatives aux participations

Pour que votre participation soit considérée comme étant une Participation admissible (tel qu’il est défini ci-dessous), tout le contenu et tous les documents associés à votre participation (peu importe le mode de participation) (collectivement, le « Matériel ») doivent : (i) être soumis et reçus conformément au présent Règlement du Concours pendant la Période du Concours applicable; (ii) inclure tous les éléments requis susmentionnés; et (iii) respecter le présent Règlement du Concours, notamment, y compris et sans s’y limiter, les conditions générales énumérées ci-dessous pour chaque Prix (le tout étant déterminé par l’Organisateur du Concours à sa seule et entière discrétion). Tout Matériel reçu de la part d’un Participant admissible qui répond aux exigences susmentionnées sera considéré comme une « Participation admissible » et collectivement comme les « Participations admissibles ».

3.Prix et tirage des Prix

Un total de 23 prix (chacun, un « Prix » et, collectivement, les « Prix ») peut être gagné pendant la Période du Concours; ils consistent en :

Prix secondaires. Un total de huit (8) prix secondaires (les « Prix secondaires ») peut être gagné par les Agents de voyages admissibles.

Pour choisir les gagnants de tous les Prix secondaires indiqués ci-dessous, un tirage au sort parmi toutes les Participations admissibles reçues des Agents de voyages admissibles aura lieu virtuellement, le 2 juillet 2024, dans les bureaux de l’Organisateur du Concours, situés au 20, rue Queen Ouest, 26^e étage, Toronto (Ontario), M5H 3R3 :

1. Une (1) participation sera tirée au sort pour gagner un (1) cristal de Tourism Ireland d’une valeur de 100 $ US (environ 135 $ CA).
2. Deux (2) participations seront tirées au sort pour gagner une (1) Carte-cadeau Air Canada de 100 $ ou un (1) bagage de cabine à l’emblème de l’entreprise d’une valeur de 100 $ CA.
3. Une (1) participation sera tirée au sort pour gagner une (1) paire paire de laissez-passer pour un salon Feuille d’érable international d’une valeur de 100 $ CA.

Valeur totale des Prix

La valeur approximative de tous les Prix réunis est de 27 088,20 $ CA.

La valeur exacte du Prix dépend des aéroports de départ et de destination ainsi que de la période de voyage. Les Prix doivent être acceptés tels qu’ils sont attribués; ils ne peuvent être vendus, transférés ou monnayés, et ils ne seront pas remboursés s’ils ne sont pas utilisés. Aucune substitution, modification ou prolongation n’est permise. L’Organisateur du Concours se réserve le droit, à sa seule discrétion, de substituer au Prix un autre prix de valeur égale ou supérieure ou d’en autoriser le transfert.

Nota : Le présent Concours sera administré en conformité avec les règles fiscales fédérales et provinciales. Le Prix constitue un revenu imposable, sauf dans des circonstances limitées. 5.Participation à la Course

Les Agences admissibles sélectionnées par tirage au sort seront jointes par téléphone ou par courrier électronique par l’Organisateur du Concours, le Commanditaire du Concours ou l’un de leurs représentants. Une fois jointe, afin d’être officiellement déclarée participante à la Course, l’Agence admissible doit confirmer son acceptation et fournir le nom de son Participant à la Course dans les cinq (5) jours ouvrables suivant le premier avis (le « Participant à la Course »). Si l’Agence admissible sélectionnée ne peut être contactée dans les cinq (5) jours ouvrables, une autre Agence admissible sera sélectionnée selon les méthodes décrites précédemment. Seules les Agences admissibles sélectionnées dont la Participation admissible a été tirée au sort seront contactées. Une fois que la participation à la Course de l’Agence admissible confirmée, le Commanditaire du Concours enverra à l’Agence admissible et à son Participant à la Course une lettre contenant les détails relatifs à la Course.

Le Participant à la Course, s’il est sélectionné, devra être disponible pour voyager aux dates précisées.

Aucun point Aéroplan ni aucun mille ou point d’un autre programme de fidélité ne seront accordés pour le voyage. Aucune modification de réservation ne sera permise une fois la date de voyage confirmée ou le billet délivré.

La date de départ, du grand aéroport canadien desservi par Air Canada le plus près du domicile du Participant à la Course et à destination de Dublin, en Irlande, est prévue le 21 septembre 2024 et la date de retour, de Dublin, en Irlande, au grand aéroport canadien desservi par Air Canada le plus près du domicile du Participant à la Course est prévue le 28 septembre 2024. L’Organisateur du Concours se réserve le droit de modifier les dates de la Course, y compris les dates de voyage. L’Organisateur du Concours fournit à tous les Participants à la Course le billet aller-retour en classe économique pour un vol exploité par Air Canada (y compris les vols exploités sous la marque Air Canada Express et ceux exploités par Air Canada Rouge).

Les Participants à la Course sont responsables de ce qui suit : les frais, dépenses et taxes qui ne sont pas énoncés aux présentes, notamment le transport terrestre, les pourboires, les marchandises, les appels téléphoniques, les dépenses personnelles de quelque nature que ce soit pour les escales de nuit, les repas et les boissons, les frais de gestion, les repas et les divertissements à bord, les frais de déplacement pour se rendre au point de départ et en revenir, car c’est là que le Prix débute et prend fin; la souscription, au besoin, d’une assurance voyage suffisante, avant le départ; l’obtention de tous les documents de voyage nécessaires, tels que passeports et visas; la conformité aux règles et aux exigences d’entrée, de santé, de sécurité, de douane et d’immigration. Les Participants à la Course acceptent et reconnaissent que l’Organisateur du Concours sera exonéré de toute responsabilité s’ils se voient refuser l’embarquement en raison du non-respect de certaines restrictions ou exigences de voyage applicables.

Les Participants à la Course et leurs invités comprennent et acceptent les risques associés à la propagation de maladies infectieuses ou transmissibles et comprennent qu’ils ont la responsabilité de prendre les précautions nécessaires en la matière, notamment en ce qui concerne la COVID-19.

D’autres protocoles de sécurité obligatoires peuvent s’appliquer en fonction de la nature du Prix. L’accessibilité de certains services ou de certaines installations peut être affectée.

L’Organisateur du Concours se réserve le droit d’annuler la Course à sa seule discrétion.

6.Réclamation des Prix

Afin d’être déclaré gagnant et de pouvoir réclamer son Prix, le Participant admissible sélectionné, conformément au présent Règlement du Concours, sera joint par téléphone, courriel, message direct ou autre au moyen des coordonnées jointes à la Participation admissible sélectionnée et recevra des directives pour la réclamation de son Prix de la part de l’Organisateur du Concours ou du Commanditaire du Concours (le cas échéant) ou d’un de ses mandataires ou représentants peu de temps après le tirage, et il devra consentir à être sélectionné comme Participant admissible dans les cinq (5) jours civils qui suivent. Chaque gagnant potentiel d’un Prix est seul responsable de s’assurer que les paramètres de son compte de média social sont configurés de manière à ce qu’il puisse recevoir ces messages d’avis de l’Organisateur du Concours (le cas échéant).

Si le Participant admissible sélectionné ne donne pas son consentement dans les cinq (5) jours civils qui suivent, le Participant admissible sera automatiquement disqualifié et perdra tous ses droits au Prix. Seuls les Participants admissibles sélectionnés dont la Participation admissible a été tirée au sort seront contactés. Lorsqu’un Participant admissible est déclaré gagnant d’un Prix par l’Organisateur du Concours, ce dernier lui enverra par courriel les détails de la marche à suivre pour réclamer son Prix.

7.Conditions générales

Tout le Matériel et tous les renseignements fournis par les Participants admissibles doivent être complets et exacts. L’Organisateur du Concours ne sera pas tenu responsable de toute transcription incorrecte ou inexacte de l’information figurant sur la participation, de toute erreur ou de tout dysfonctionnement technologique de quelque nature que ce soit en rapport avec le Concours, des interruptions des services téléphoniques ou Internet, ni d’aucune réclamation de Prix ou formulaire de déclaration en retard, incomplet ou mal rempli, ni de la disqualification valable de tout Participant admissible ou gagnant conformément aux conditions des présentes.

Tout le Matériel peut être vérifié par l’Organisateur du Concours et être invalidé s’il est reçu en dehors de la Période du Concours, s’il est incomplet, illisible, irrégulier, photocopié ou reproduit de quelque autre manière ou soumis par des moyens illicites, s’il contient de fausses déclarations, ou s’il ne se conforme pas au présent Règlement du Concours ou ne satisfait pas à ses conditions quelles qu’elles soient.

Si le Concours ne peut se dérouler comme prévu, pour quelque raison que ce soit, notamment des falsifications, des interventions non autorisées, des fraudes, des défaillances techniques ou toute autre cause, l’Organisateur du Concours se réserve le droit, à sa seule discrétion et sans préavis, de suspendre le Concours ou d’y mettre fin, en tout ou en partie, ou de le modifier de quelque façon que ce soit, sans autre obligation envers les Participants admissibles. En outre, si l’Organisateur du Concours estime, à sa seule discrétion, qu’une participation compromet l’intégrité du Concours, il se réserve le droit de l’annuler ou de mettre fin au Concours dans son ensemble, sans autre obligation envers les Participants admissibles. L’Organisateur du Concours se réserve par ailleurs le droit, à sa seule discrétion, de disqualifier toute personne du présent Concours ou de révoquer, d’annuler, de retenir ou encore de limiter ou de restreindre l’accès au Prix attribué à un gagnant, et de bannir de tous les concours qu’il pourrait organiser ultérieurement toute personne responsable ou soupçonnée : (i) d’intervenir de façon illicite dans le processus de participation ou le déroulement du Concours; (ii) de contrevenir au Règlement du Concours ou de faire preuve d’une conduite déloyale ou perturbatrice, ou d’agir dans l’intention d’importuner, d’injurier, de menacer ou de harceler une autre personne; (iii) d’agir ou de participer à une situation ou à un événement d’une manière qui ferait d’elle l’objet de discrédit, de mépris, de scandale d’ordre public ou de ridicule, ou qui choquerait, insulterait ou offenserait une communauté ou un groupe ou une classe de celle-ci, ou qui porterait atteinte à la moralité et à la décence publiques, ou qui donnerait une image défavorable à l’Organisateur du Concours, au Commanditaire du Concours (le cas échéant), au fournisseur du Prix, s’il y a lieu, et à leurs sociétés mères, filiales et sociétés affiliées, partenaires médias, agences de publicité et de promotion, et tous les administrateurs, dirigeants, employés, mandataires, représentants, successeurs et ayants droit de chacune de ces entités, ou à leurs produits et services respectifs, tel que déterminé à la discrétion raisonnable de l’Organisateur du Concours; ou (iv) de publier ou de rendre accessible au public tout message, image, vidéo, déclaration ou tout autre type de contenu sur tout média (y compris toute plateforme de médias sociaux), le cas échéant, mentionnant, étiquetant, faisant allusion ou s’associant de quelque manière que ce soit au Concours ou au Prix qui, à la discrétion raisonnable de l’Organisateur du Concours, enfreint ou viole de quelque manière que ce soit les droits de l’Organisateur du Concours, du Commanditaire du Concours (le cas échéant), du fournisseur du Prix, s’il y a lieu, et de leurs sociétés mères, filiales et sociétés affiliées, partenaires médias, agences de publicité et de promotion, et tous les administrateurs, dirigeants, employés, mandataires, représentants, successeurs et ayants droit de chacune de ces entités.

En participant à ce Concours, les Participants admissibles conviennent que l’Organisateur du Concours, le Commanditaire du Concours (le cas échéant) et leurs filiales et sociétés affiliées, partenaires médias, agences de publicité et de promotion, et tous les administrateurs, dirigeants, employés, mandataires, représentants, successeurs et ayants droit de chacune de ces entités ne font aucune déclaration, n’offrent aucune garantie et n’assument aucune responsabilité au-delà, s’il y a lieu, de ce qui a été décrit comme étant le Prix dans le présent Règlement du Concours.

Les Participants admissibles acceptent de respecter toutes les décisions de l’Organisateur du Concours ou du Commanditaire du Concours (le cas échéant) relativement au Concours, lesquelles sont exécutoires et sans appel à tous égards.

Le Concours est régi par la réglementation fédérale, provinciale et locale en vigueur. Sous réserve du paragraphe suivant, le présent Concours est régi par toutes les lois et tous les règlements nationaux, fédéraux et provinciaux applicables; à moins que la loi n’en dispose autrement, toutes les actions, toutes les procédures ou tous les litiges relatifs aux présentes seront tranchés dans le district judiciaire de Montréal, province de Québec, et les parties consentent à ce lieu et à cette compétence exclusifs.

Propriété intellectuelle. Toute propriété intellectuelle, notamment les marques de commerce, les appellations commerciales, les logos, les concepts, le matériel promotionnel, les pages Web, le code source, les dessins, les illustrations, les slogans et les déclarations, appartient à l’Organisateur du Concours, au Commanditaire du Concours (le cas échéant) ou à leurs sociétés affiliées. Tous droits réservés. Toute reproduction ou utilisation non autorisées de tout matériel ou toute propriété intellectuelle protégés par des droits d’auteur sans le consentement écrit du propriétaire est strictement interdite.
