Terms And Conditions

The following sets forth the terms and conditions for requesting participation in the Porsche Golf Cup USA Final 2024 competition (the “Tournament”) offered by Porsche Cars North America, Inc., 1 Porsche Drive, Atlanta, GA 30354 (“PCNA”). 

1. Eligible Participants; How to Participate
The Porsche Golf Cup USA Final 2024 is an invitation-only tournament to take place April 7-9, 2024 in San Diego, California. Invitations are non-transferable. Participants must register via www.porschegolfusa.com with their interest to participate by December 17, 2023.  Registration is only an expression of interest and not a guaranteed spot to participate in the Tournament.

To reigster you:

  • Must be a U.S. resident at least 21 years of age or older as of April 7th, 2024
  • Must be a current Porsche owner with VIN registered in player’s name or spouse/partner’s name
  • Must have a registered USGA handicap or proof of verifiable handicap
  • Must return a signed and notarized affidavit prior to the first day of the program April 1, 2024.

Employees, officers, and directors of PCNA (and their parents, subsidiaries, affiliates), dealerships, advertising and promotional agencies, any other persons or entities involved in the development and/or administration of the Tournament (collectively, “Tournament Entities”), and their immediate family members (parent, child, sibling, or spouse/partner) and/or household members (whether or not related) are not eligible to participate in the Tournament. Active or retired professional golfers on any professional golf tours, including but not limited to the PGA Tour, LPGA, Web.com, PGA TOUR Canada, PGA TOUR Latinoamérica, PGA TOUR China, and Symetra Tour, are not eligible to participate, unless PCNA has granted a waiver in writing.

All federal, state, and local laws apply.

2. Selection of Tournament Participants

On or about January 31, 2024 PCNA shall select from those who have registered their interest (“Registrants”) who will actually be invited to participate in the Tournament (“Participants”).  Selection will be random but with consideration for geographical and handicap category distribution.

3. Prize  
Each Participant shall receive:

  • Round-trip coach-class airline ticket from their home city to San Diego, California through PCNA’s designated travel agency
  •  Two-night accommodations at The Park Hyatt Aviara
  • Airport transfers to/from the resort on group arrival/departure dates
  • Welcome reception
  •  Golf tournament fees
  •  Awards reception & dinner

The approximate retail value (“ARV”) of participation in the tournament is $2,700.00.  ARV will vary based on home city, time of booking, etc.
Participants are solely responsible for all other expenses not specifically mentioned herein, including but not limited to meals (other than those identified above) and ground transportation and/or parking in their home city). 

Participants are responsible for any and all federal, state, and local taxes associated with participation in the Tournament.   Each participant shall be required to complete and return a signed affidavit to PCNA and will be issued an IRS Form 1099 for the retail value of trip. Participants are advised to seek independent counsel regarding the tax implications of participation. 

4. General Conditions 
Participants agree to be bound by these Terms and Conditions and the decisions of PCNA, which are final and binding in all respects. By participating, each agrees and acknowledges that PCNA is not responsible for and shall not be liable for: (i) any injuries, losses or damages of any kind caused by a prize or resulting from acceptance, possession or use (including, without limitation, any travel or activities related thereto) or misuse of any prize or from participating in the Tournament; or (ii) any printing, typographical, administrative, human or technological errors in any way associated with the Tournament. PCNA has not made and/or is not responsible for any misrepresentation or guaranty, express or implied, in fact or in law, relative to the prizes.  PCNA reserves the right, at its sole discretion, to modify, cancel or suspend this Tournament (or any portion of the Tournament) should any cause or problem corrupt or inhibit the administration, security or proper operation of the Tournament and, in such situation where applicable, to select the winner(s) in such manner as deemed fair and appropriate by PCNA at its sole discretion. 

PCNA may prohibit persons from participating in the Tournament if, at its sole discretion, it determines a person is attempting to undermine the legitimate operation of the Tournament by cheating, deception, or other unfair practices or intending to annoy, abuse, threaten or harass any other participants or PCNA’s representatives.  CAUTION:  ANY ATTEMPT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE PROGRAM MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE PROGRAM. SHOULD SUCH AN ATTEMPT BE MADE, PCNA RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.  

All issues and disputes concerning the Tournament shall be governed by, and construed in accordance with, the laws of the State of Georgia without regard to any choice of law or conflict of law rules.  Except where prohibited, by participating and/or enrolling into this Tournament, each participant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Tournament, or awards, shall be resolved individually, without resort to any form of class action; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees; and (c) under no circumstances will any participant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow the limitations or exclusion of liability for incidental or consequential damages, so the above may not apply to you. The invalidity or unenforceability of any provision of these Terms and Conditions shall not affect the validity or enforceability of any other provision so long as the general intent of these Terms and Conditions remains in effect. In the event that any such provision is determined to be invalid or otherwise unenforceable, these Terms and Conditions shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained herein.

5. Privacy
Any personal information that a participant provides in connection with this requested to participate in the Tournament may be used by PCNA in accordance with its privacy policy located at https://www.porsche.com/usa/privacy-policy/.

6. Odds 
Odds of winning a Prize depend on the number of eligible people requesting to play in the Tournament players in your geographic area and handicap category.

7. Winners List/Terms and Conditions 
For the names of the winners, or a copy of these Terms and Conditions, send a self-addressed, stamped envelope (VT residents need not affix return postage) to:
