Brokers and Surface Freight Forwarders
Federal regulations governing brokers; Broker surety bonds; Maintaining independent contractor status; Surface freight forwarders and how they are legally different from brokers
 
Motor Carriers
Laws and regulations affecting motor carriers in a “de-regulated environment”; Interstate Commerce Commission Termination Act (ICCTA); Exempt and non-exempt operations and why they matter
 
Air and Ocean Carriers and Intermediaries
Laws and Treaties affecting direct and indirect air carriers; Ocean carriers, ocean freight forwarders, non-vessel operating common carriers (NVOCC’s); Intermodal marketing companies (IMC’s)

Exposures to Liability
Shippers and carriers duties and exposures to lawsuits, Liability for highway accident injuries and death:  Schram v. Foster and the C.H. Robinson cases, safety rating system, SafeStat scores, CSA 2010; qualifying carriers to minimize risk

Bills of Lading; Individually negotiated contracts; Pricing agreements; The four critical issues in transportation contracting
 
Terms of Sale
FOB Origin and Destination & the Uniform Commercial Code (UCC); International Sales & Incoterms 2010           
           
Payment of Freight Charges
Responsibility for freight charges:  Consignor or consignee, collect & prepaid; the 180 day rule; the 18 month statute; motor carrier credit regulations
 
Insurance
Cargo insurance and cargo liability insurance; the insurance policies a broker should have

NOTE:  Prior attendance at a previous "one day" course is a prerequisite to registration for the half day course.  The prior attendance can be either the one day course immediately prior to the optional half day course or any other prior "Transportation, Logistics and the Law for 3PLs" course presented by either William J. This closing session is intended to provide time for questions from the audience and case studies based upon problems and situations which have been encountered by the audience.
