General Terms and Conditions

1. Scope

These terms and conditions govern the contractual relationship between the HIMSS Europe GmbH as exhibition/event organisers on the one hand and the participants of a meeting of HIMSS Europe GmbH on the other hand. Deviating conditions of the participant are not valid.

2. Registration

Each registration constitutes an offer to conclude a contract and only becomes legally binding when the registration is confirmed via email by HIMSS Europe GmbH (acceptance). The participant acknowledges the validity of the General Terms and Conditions upon registering. Event participation requires full payment of the registration fee. This is due within 30 days immediately after receipt of the invoice unless different payment terms were agreed in the offer. The participation fee is per company and event date. It includes participation in the event in question and the services specified in the offer for the event.

3. Programme changes

HIMSS Europe GmbH reserves the right to make changes to the content of the programme, as well as replacement and omission of the announced speakers if the overall character of the event remains the same. If an event has to be cancelled or postponed for good cause or due to force majeure, HIMSS Europe GmbH is obliged to notify the registered participants immediately. In this case, the participant may request a refund of the pro-rated event fee for unused services. Other costs (e.g. travel and accommodation costs) are excluded from reimbursement, unless there was grossly negligent conduct on the part of HIMSS Europe GmbH.

4. Terms of payment

Payment is due no later than 30 days before the start of the event. If the participant ticket is purchased in fewer than 30 days before the event, the amount is due immediately. If the invoice amount is not paid by 10 days prior to the event, HIMSS Europe GmbH reserves the right to refuse admission. The right to payment remains.

5. Withdrawal

If the participant is unable to attend, they are entitled to deregister from participation. Cancellation (withdrawal) by the participant, which must be made in writing by 30 business days before the event, is possible by withholding a processing fee of €100. In the case of late cancellation (fewer than 30 business days) or a no show, the full participation fee is due.

6. Copyright

All documents given out for the event by HIMSS Europe GmbH are copyrighted. Duplications and other uses require written approval by HIMSS Europe GmbH.

7. Liability

All events are researched, prepared, and organised with due care. If damage occurs in spite of this, HIMSS Europe GmbH assumes no liability for the completeness, accuracy in terms of lecture content, and issued documents. Moreover, HIMSS Europe GmbH is liable only for intentional or grossly negligent conduct (in particular the conduct of its legal representatives, employees, and agents). Nevertheless, the installer is solely liable for any injury or damage caused by state institutions/exhibits of the exhibitor or their assembly and dismantling (taking out exhibition insurance is recommended).

8. Privacy policy

HIMSS Europe GmbH treats transmitted personal data in accordance with the applicable data protection regulations. It is electronically saved for the purpose of provision of services. In addition, HIMSS Europe GmbH reserves the right to further use of the data for communication purposes, provided that the participant does not expressly prohibit this.

9. Final provisions

The contract is subject to German law. Place of jurisdiction is Berlin.
