This introductory course will cover the following topics:-


1. Financial provision on divorce  - This webinar will look at the two parts of financial provision - capital and aliment. It will highlight the importance of managing your client's expectations. It is essential to have good knowledge and technical skills but with the uncertainty around the outcomes of litigation, being able to communicate openly and clearly with your client is equally important.

2. The law of cohabitation/cohabitant's rights - This webinar looks at the basics of the law of cohabitation and cohabitation rights as it relates to family law. It will give you an understanding of who and what is covered by the legislation.  Shona Smith, Partner at Balfour + Manson LLP will discuss potential claims on separation in terms of financial provision, household goods, occupancy rights and child support.

3. Adoption and permanence orders - This webinar provides an overview of adoption and permanence orders. Lindsey Ogilvie, Senior Associate at Turcan Connell will look at the substantive law, both the various statutory provisions and the leading cases which set out the way in which the legislation is to be navigated.

4. Domestic abuse and child law - This webinar is about child law and domestic abuse and what the court MUST consider when granting a section 11 order where there has been or there is risk of domestic abuse under the Children (Scotland) Act 1995 as amended section 11(7A-E).  Having an appreciation of domestic abuse and how victims respond will allow you to provide a sensitive and appropriate service to those clients who have experienced it.

5. Domestic abuse and protective orders - During this webinar Gillian Baker, Women and Children's Solicitor at the Domestic Abuse Transactions Advice Project, will discuss the legal remedies available to individuals who are suffering, or are likely to suffer from domestic abuse. These remedies include orders which are designed to stop domestic abuse from occurring.

6. Departures from equal sharing of matrimonial property - This webinar will look at the black letter law in relation to departures from equal sharing for special circumstances and financial advantage/disadvantage. Anne Dick, Partner at Family Law Matters Scotland will examine how this has been interpreted by the courts and will consider how to apply this knowledge in practice.
