This is the final part of our certificated learning in family law. The certificated learning is regarded as an important milestone before going on to apply for the full Law Society accreditation in family law. Completing this training is an ideal way to support your application.
The advanced course will cover the following topics:-
1. Defences to petitions under The Hague Convention - This webinar covers possible defences under the Child Abduction and Custody Act 1985. The Act is the statute under which the Hague Convention has force of law in the UK.
2. An introduction to jurisdictional issues in family law - This webinar aims to provide you with a broad overview of the jurisdictional rules in relation to divorce and financial proceedings and to matters involving parental responsibilities. During the webinar Denise Laverty, an accredited specialist in family law will look at what determines jurisdiction and what is meant by habitual residence, residence and domicile.
3. A comparison between Scotland and England - the principles of financial provision - This webinar provides a comparison between Scotland and England and Wales in terms of the approach to financial provision following the breakdown of a marriage or civil partnership. While there are differences both in the principles and the procedures which the respective courts apply to financial provision, this webinar will focus on the principles rather than the practicalities of court process.
4. Drafting pre and post nuptial agreements - Jennifer Gallagher, a partner at RSB Lindsays and an accredited specialist in family law, will explain what you should be considering when drafting a pre or post nuptial agreement.
