Completing this introductory course will give you an insight to the basics of employment law, the course will cover the following topics:-
1. Basic Guide to TUPE - TUPE is a varied and complex subject and this module will cover the basics. You will look at when TUPE is applied and you will look in detail at the process of a business and share sale. This module will also cover service provision changes, varying terms and conditions, transfer related dismissals and employee liability information.
2. Contracts of Employment - This module will give you a clearer understanding of the distinction between a contract of employment and any other contract. When normal contract rules apply to contracts of employment and when they do not.
3. Unfair Dismissal & Termination of Employment - within this module you will look at the law relating to unfair dismissal and examine the most recent case law. Covering areas such as; what is dismissal, automatically unfair dismissals, what is a fair dismissal, potentially fair reasons for dismissal, reasonableness of the dismissal, fair dismissal procedure, bringing a claim for unfair dismissal, remedy and quantum of claims and constructive dismissal.
4. Negotiating and Agreeing Settlement Agreements - Formerly known as compromise agreements, settlement agreements are a specific way of recording and settling employment disputes between individuals and their employers. So whether you are acting on behalf of a client or you are in the process of preparing to draw up a settlement agreement then this module takes you through the process.
5. Basic Guide to Discrimination & Family Friendly Policies - Being aware of the protected characteristics is important but being able to identify the types of discrimination is key to your understanding in what can be a sensitive area of the law. This module will give you a better understanding of the protected characteristics, the types of discrimination, vicarious liability, public sector issues, when discrimination may be lawful and bringing and defending claims. Family friendly policies can be a difficult area and you may at times find that you struggle to answer questions on this technical subject.
6. Redundancy & Business Re-organisation - During this module, you will hear about the various circumstances which can be covered by the definition of redundancy. Having completed this module, you will have a better understanding of business closures, workforce redundancy, diminishing need for employees, pool of selection, notifying the affected employees, selection criteria, individual consultation, appeals, common issues encountered during consultation, collective redundancies, practical considerations on termination of employment for redundancies and redundancy pay
