CPD for New Lawyers: Domestic Abuse - Legal Responses

Domestic abuse is a massive social problem and yet it is still widely misunderstood.
Presented by Scottish Women’s Aid, this session will explore what is meant by domestic abuse and how it impacts on a victim’s ability to make use of legal remedies.
Recent legislative developments provide a potential increase in protection for those experiencing domestic abuse. This seminar will provide a user-friendly overview of the range of protective measures available under the law, relating to domestic abuse.
It will consider essential elements of criminal and civil law, highlighting their potential and limitations as sources of protection for those experiencing domestic abuse.
Topics covered will include interdicts, non-harassment orders, exclusion orders and police responses to domestic abuse, stalking and harassment.
Aimed at students, new lawyers, trainees and members with less than five year PQE, this seminar will be of particular benefit to those looking for an insight into how to deal with and give advice regarding domestic abuse cases.
By the end of the seminar delegates will be able to:
• Reframe domestic abuse as a course of coercive and controlling conduct which produces compliance in the victimised partner through fear and the creation of a sense of entrapment
• Appreciate the impact of domestic abuse on those who experience it and how it affects their behaviour and choices
• Draw on their knowledge of the range of civil protective orders available to those experiencing domestic abuse in order to inform them of the options open to them
• Provide those affected by domestic abuse with information about criminal justice responses and how these can be used to further protect them from abuse
