Estate or Legacy administration is the final part of the gifts in Wills giving journey. After a donor has died and the Will is executed, there can be a period of months, if not years in some circumstances, before the gift is realised to the charity. During this time, there is a lot that a charity can do to influence the outcome and value of the bequest gift. This is an area that can often be misunderstood or overlooked in many organisations – it may be a simple ‘thanking and banking’ exercise and little time or investment is put in this area.

However, we know that good estate administration can be as important of the gifts in Wills giving journey as fundraising and marketing itself:

  • Good estate administration protects the charity from unnecessary risk
  • It can speed up the time that income is received
  • It can build strong relationships with next of kin and solicitors, to positively influence future giving
  • It can give the organisation vital information about future income for forecasting purposes
  • It can increase the value of gifts in Wills giving to the charity

The biggest case for a proactive approach to estate administration is that Legacy Link believe this adds between 5-10% in the value of bequest giving. Based on the estimated size of the Australian market, this could be between A$37-74 million in additional giving each year, if we adopted a consistent, proactive approach to estate administration.

Over the course of three webinars, Legacy Link consultants from the UK will share their experience and about how good practice in estate administration can become a core pillar of your Gifts in Wills strategy. They will also provide information on how to navigate state legislation and other Australian regulations that need to be adhered to. Each webinar will include a pre-recorded session followed by live Q&A.

 

Webinar 1 – Estate Administration 101

Wednesday 4 November 3.30pm – 5pm AEST

This webinar will explain the important role of legacy administration officers in building key relationships with professionals and the general public, whilst protecting the Charity’s income and reputation during the process.

In this webinar we will cover:

  • The role of the estate administration officer
  • Understanding the relationships between charity and executors
  • Wills – the law and validity
  • Intestacy – what does it mean?
  • What type of gifts can you leave in Wills?
  • The grant of probate – how Wills are executed
  • The beneficiaries right to information during the estate administration process
  • Executors duties and responsibilities

 

Webinar 2 – General principles for good estate administration

Wednesday 11 November 3.30pm – 5pm AEST

The second webinar will explain the general estate administration process following notification of a gift through to receipt of funds and file closure. You will learn about requesting relevant information from Solicitors/Executors to enable you to closely estimate your charity’s entitlement, taking into consideration potential taxation and property issues. Tips for working collaboratively with co-beneficiaries and practising proactive file management will also be offered.

 

Webinar 3 - Governance and other legal considerations

Wednesday 18 November 3.30pm – 5pm AEST

The third and final webinar will cover the legal obligations concerning restricted gifts, Charity Board obligations and what to do when gifts in Wills become contentious:

  • Understanding restricted gifts and your legal obligations
  • Charity trustee obligations and how to delegate authority
  • Dealing with ex-gratia claims from the estate
  • Understanding the different claims that may be made against the estate
  • When to instruct legal advice
  • How to identify fraud and what to do if you suspect fraudulent activity in an estate
